Earphones and Headsets 

Have you ever seen someone driving with headphones on listening to music?  Maybe you have done it yourself once or twice.  With the popularity of iPods©, portable M3P players, etc., this is becoming more common.  Actually, it’s against the law.

§ 31-23-51 Earphones and headsets prohibited. – (a) A person shall not drive a bicycle or motor vehicle upon any highway while wearing earphones or a headset. Any person who violates this section shall be fined (1) sixty dollars ($60.00) for the first offense, (2) seventy dollars ($70.00) for the second offense, and (3) one hundred forty dollars ($140) for the third and each subsequent offense.

(b) This section shall not apply to any emergency vehicle operator using an integrated intercom system.

If you use a hands-free device for a cellular phone in one ear, that is legal and strongly recommended.
